US Cuts Turkey Out of F-35 Fighter Jet Program

The United States is officially removing Turkey from its F-35 stealth fighter jet program after Ankara accepted the Russian delivery of its S-400 missile defense system.”Unfortunately, Turkey’s decision to purchase Russian S-400 air defense systems renders its continued involvement with the F-35 impossible,” the White House said in a statement Wednesday. “The F-35 cannot coexist with a Russian intelligence collection platform that will be used to learn about its advanced capabilities.”U.S. officials believe NATO ally Turkey’s decision to use Russian advanced radar technology could compromise the alliance’s military systems in the country. The S-400 could potentially be used to target NATO jets in Turkey, including the U.S.-made F-35, which is NATO’s newest stealth fighter jet.Defense Secretary nominee Mark Esper testifies before a Senate Armed Services Committee hearing on his nomination in Washington, July 16, 2019.On Tuesday, President Donald Trump’s nominee to be the next secretary of defense slammed Turkey’s acceptance of the S-400, parts of which were delivered last week, as “wrong” and “disappointing.” Mark Esper told lawmakers he emphasized in a phone call to Turkey’s Defense Minister Hulusi Akar that “you can either have the S-400 or the F-35. You can’t have both.”A Russian transport jet delivered the first parts of the $2.2 billion missile system last Friday to a Turkish military air base outside Ankara.Washington’s decision to cut Turkey out of the F-35 problem means delivery of the aircraft has stopped, and Turkish firms will lose contracts to build significant parts of the expensive and complex U.S. jet.Turkey’s Ministry of National Defense has said its purchase of the S-400 defense systems was “not an option but rather a necessity.” The ministry said last week that Turkey was still assessing the bid to acquire U.S. Patriot air defense systems. But the White House countered Turkey’s assertion on Wednesday.”The United States has been actively working with Turkey to provide air defense solutions to meet its legitimate air defense needs, and this administration has made multiple offers to move Turkey to the front of the line to receive the U.S. PATRIOT air defense system,” the White House said. The White House added that Turkey has been a “longstanding and trusted partner and NATO Ally for over 65 years,” but that “accepting the S-400 undermines the commitments all NATO Allies made to each other to move away from Russian systems.”Turkey’s President Recep Tayyip Erdogan waves to supporters following a rally to honor the victims of the July 15, 2016 failed coup attempt, part of the ceremonies marking the three-year anniversary, in Istanbul, July 15, 2019.Turkish officials argue Turkey is in a complicated geopolitical region, as it borders Iran, Iraq, and Syria. Three years ago, the Turkish presidential palace was bombed by rogue elements of its military in an attempted coup, and some analysts suggest the missiles could be used to protect Turkish President Erdogan. While the S-400 is widely recognized as one of the most advanced missile systems in the world, its practical use is in question, given its incompatibility with the rest of Turkey’s NATO military systems.”From a military perspective there is no logic,” said retired General Haldun Solmazturk, who now heads the Ankara-based 21st Century Institute research institution. “This is not only a problem between Turkey and the United States, but it is a problem between Turkey and the rest of the 28 NATO members, so it’s a serious problem.”

French Prosecutors Want Air France Tried for 2009 Crash

PARIS — French prosecutors want Air France to stand trial for manslaughter in the 2009 crash of a flight from Rio de Janeiro to Paris that killed all 228 people aboard, a judicial official said Wednesday.

Prosecutors also have asked that the case against Airbus, maker of the doomed aircraft, be dropped for lack of evidence. The official wasn’t authorized to speak about the case and asked to remain anonymous.

Air France Flight 447 left Rio de Janeiro for Paris but crashed into the Atlantic Ocean on June 1, 2009. The Accident Investigation Bureau found that external speed sensors were frozen and produced irregular readings on the aircraft, which went into an aerodynamic stall.

A plethora of problems appear to have doomed the flight as it traveled through turbulence. The captain was on a rest break when the emergency arose, the autopilot disengaged and the co-pilots struggled to fly the aircraft manually.

In their final summing up on Friday of the investigation, prosecutors cited negligence and insufficient training that led to chaos in the cockpit.  Airbus had warned pilots a year earlier about possible incorrect speed readings from the plane’s external sensors, known as Pitot tubes, but changed them only after the crash.

A report last year that was part of the judicial investigation blamed the Flight 447 pilots for failing to apply correct procedures, thus losing control of the aircraft.

A victims group, AF 447 Victim Solidarity, contested the 2018 report, saying it freed Airbus of all responsibility in the accident.

Victims’ Families, Nations Commemorate MH17 Tragedy

Families of victims and their countries’ embassies are marking the fifth anniversary of the downing of Malaysia Airlines flight MH17 over the conflict zone in eastern Ukraine, amid mounting evidence of Russia’s involvement in shooting the passenger plane out of the sky.The airliner flying between Amsterdam and Kuala Lumpur was shot down by a Buk missile on July 17, 2014, over territory in eastern Ukraine controlled by pro-Russian separatists, killing all 298 people on board, including 80 children. In the Netherlands, which lost 193 citizens, commemorations began on July 16, when family members of 15 of the victims assembled in the town of Hilversum for a vigil. It was led by a priest who grows sunflowers from seeds brought from eastern Ukraine where the plane was shot down.A separate MH17 conference took place in the Netherlands on July 16, as well as a roundtable in Washington, D.C.Speaking in Washington, George Kent, deputy assistant secretary of state at the Bureau of European and Eurasian Affairs, said that “Russia set the stage for the shoot-down of MH17 by financing, organizing, and leading proxies in eastern Ukraine.”He also said that “Russia continues to deny the presence of its forces and materiel” in non-government-controlled parts of Ukraine.Moscow has repeatedly denied any involvement in the MH17 tragedy.Nine embassies whose citizens perished on the flight plan to hold a memorial on July 17 in Malaysia, which lost 43 citizens.Another memorial is taking place at Schiphol Airport in Amsterdam that is closed to the media.Investigators from the Dutch-led Joint Investigative Team (JIT) have concluded that a Russian antiaircraft-missile brigade transported the sophisticated projectile system from and back to Russia into Ukraine. The JIT in June furthermore indicted three Russians with military and intelligence backgrounds and a Ukrainian man with no prior military experience on murder charges. The four suspects are scheduled to be tried starting in March 2020 in the Netherlands, although all are believed to be in Russia. And investigators promised to continue investigating suspects, including those in the “chain of command.”Western states imposed sanctions on Russia after the incident, bolstering existing measures that were put into force after Russia annexed Ukraine’s Crimean Peninsula in March 2014.Dutch prosecutors might get to question a possible key witness of the events after an elite Ukrainian unit on June 27 detained Volodymyr Tsemakh at his home in a separatist-held city in the Donetsk region.Tsemakh oversaw an air-defense unit in a town near the crash site. His lawyer and daughter told local media that Ukrainian authorities are charging him with terrorism that carries a maximum 15-year prison sentence.Meanwhile, Tsemakh’s wife sent a pro-Moscow separatist official a picture of her husband after he was arrested with a bandaged wound on his forehead, according to online open-source sleuth Bellingcat.TV footage uncovered by Current Time, the Russian-language network led by RFE/RL in cooperation with VOA, showed Tsemakh claiming that he was in charge of an antiaircraft unit and that he helped hide the Buk missile in July 2014.He furthermore shows the interviewer where the civilian airliner fell.A July 15 RFE/RL report also outlined how Russian and Moscow-controlled media in nongovernment-controlled parts of eastern Ukraine first reported that separatists had downed a Ukrainian military plane during the time when MH17 was downed.

Police Launch Huge Operation Against 2 Major Italian and US Organized Crime

Italian police and the FBI carried out a wide-ranging joint operation involving more than 200 police officers on Wednesday following investigations which revealed links between Sicily’s Cosa Nostra and New York’s Gambino crime family. The investigation code-named “New Connection” showed a strong bond being re-established between US and Italian organized crime. Nineteen people were arrested.

The “New Connection” coordinated operation between Italy’s police and the FBI was launched at dawn on Wednesday and targeted the Inzerillo clan in the Sicilian capital Palermo and the Gambino crime family in New York. 19 arrest warrants were issued. The suspects are accused of crimes including mafia association, aggravated extortion and fraud.
The Inzerillo family had been decimated by the late “boss of bosses’ Toto” Riina in a turf war in the 1980s and had been forced into self-imposed exile in the United States. But since 2000, and with Riina’s death in prison in 2017, the Inzerillo family had been looking to reclaim its old business in Sicily helped by powerful allies in New York.
Wiretaps were carried out by the police of members of the Inzerillo family revealing strong ties between Cosa Nostra members in Sicily and organized crime in New York. Their activities involved a wide range of businesses, such as wholesale food supplies, gambling outlets and online betting.
Members of the Inzerillo family had re-built their stronghold in the Palermo area of Passo di Rignano. Among those arrested were Francesco and Tommaso Inzerillo, respectively the brother and cousin of Totuccio Inzerillo, a boss murdered by Riina’s Corleonesi group in the 1980s.
Salvatore Gambino, the mayor of the Palermo provincial town of Torretta, was also arrested with the accusation of external participation in mafia association. The operation also involved the seizure of goods belonging to the suspects worth some 3 million euros.

EU Probes Amazon Over Use of Retailer Info to Gain Edge

The European Union is opening a new front in its quest to more closely regulate big tech companies, saying Wednesday it was investigating whether U.S. online giant Amazon uses data from independent retailers to gain an illegal edge when selling its own products.EU antitrust Commissioner Margrethe Vestager said she is taking a “very close look at Amazon’s business practices and its dual role as marketplace and retailer, to assess its compliance with EU competition rules.”

In addition to selling its own products, Amazon also allows third-party retailers to sell their goods through its site. Last year, more than half of the items sold on Amazon worldwide were from third-party sellers.

The EU opened a preliminary probe into the issue last year, and Vestager said it has shown that “Amazon appears to use competitively sensitive information — about marketplace sellers, their products and transactions on the marketplace.” Using the information could give it an unfair competitive edge.

In a parallel case, Germany’s competition regulator said Wednesday that Amazon was changing some of its business conditions for traders on its online marketplace worldwide after it raised concerns about some terms. The regulator said that the changes affect a range of issues such as a one-sided exemption from liability to Amazon’s benefit as well as the place of jurisdiction for disputes.

Other EU countries like Austria, Luxembourg and Italy are also independently investigating Amazon but EU spokeswoman Lucia Caudet said the national probes did not overlap with the EU investigation.

Amazon said it would cooperate with the EU authorities, according to media reports.

The EU’s investigations into major companies like Amazon have led the way in a global push to more tightly regulate tech giants, as many governments wonder if they are becoming too big for the good of the wider economy.

Among the key questions are not only whether the tech giants abuse their market dominance to choke off competition, potentially stifling choice for consumers, but also whether they are adequately protecting users data and paying their fair share of taxes in countries where they operate.

Tech companies do huge business across Europe but pay taxes only in the EU nation where their local headquarters are based, often a low-tax haven like Luxembourg or the Netherlands. The result is they pay a far lower rate than traditional businesses. France has tried to address the problem by unilaterally imposing a 3% tax on big tech companies’ revenue in the country. The U.S. government is not happy about that and finance ministers from the Group of Seven wealthy countries will discuss the issue this week in Paris.

Ursula von der Leyen, the EU Commission President elect who should take up her role in November, has said she will try to be more vigilant to make sure such companies pay enough taxes.

Amazon has already been the target of previous EU investigations. Two years ago, officials ordered it to pay $295 million in back taxes to Luxembourg after finding that the company profited from a tax avoidance deal with the tiny European country. EU officials also investigated Amazon’s e-book business.

Meanwhile, in the U.S., the House Judiciary Committee is investigating the market power of Facebook, Google, Amazon and Apple. Congress is this week holding a two-day hearing on Facebook’s plan to create a digital currency, Libra, which governments in the U.S. and Europe have been skeptical about.

This story originated in VOA’s Ukrainian Service.  Some information is from AP.WASHINGTON — The Austrian justice minister’s Tuesday announcement that he will extradite Ukrainian oligarch Dmytro Firtash to face bribery charges in the United States has been upended by an application to reopen the case in Vienna.Last month, Austria’s Supreme Court upheld a decision granting a U.S. request to extradite the gas tycoon — who prosecutors say had business ties to President Donald Trump’s ex-campaign manager, Paul Manafort — paving the way for him to face trial in a Chicago courtroom.Firtash, who denies any wrongdoing, is facing a U.S. indictment that accuses him of a conspiracy to pay bribes in India to mine titanium, which is used in jet engines.A longtime supporter of Ukraine’s ousted pro-Russian president Viktor Yanukovych, Firtash is alleged to have made billions of dollars selling Russian-subsidized gas to the Kyiv government. He later launched profitable ventures in television and chemicals production, and has long-established connections with businessmen from the inner circle of Russian President Vladimir Putin, attracting the interests of U.S. law enforcement agencies. On Tuesday, the Austria Press Agency reported that Justice Minister Clemens Jabloner had approved Firtash’s extradition, but a Vienna state court judge ruled it could only take place after that court has decided on the defense motion to reconsider the matter.’Extremely extensive material’Court spokeswoman Christina Salzborn said the defense provided “extremely extensive material.””At the moment, there is no date set for the extradition,” Salzborn told VOA’s Ukrainian Service. “The accused applied for a reopening of the case and submitted numerous documents. … Due to the load of data and newly submitted evidence, it will take some time to assess the reopening request.”The court decision can once more be subject of an appeal, so even after the court’s decision regarding the reopening request, I don’t think the case will be finished,” Salzborn added.Asked if the reopened case could carry into fall, Salzborn said, “Yes, I guess even longer, as the decision regarding the reopening can be appealed, too. Everything is pending for the time of the reopening procedure.”A U.S. grand jury indicted Firtash in 2013, along with a member of India’s parliament and four others, on suspicion of bribing Indian government officials to gain access to minerals used in titanium-based products.Arrested in 2014Firtash was arrested in Austria in 2014 and then freed on 125 million euros ($141 million) bail. In a protracted legal battle, a Vienna court initially ruled against extradition on the grounds  the indictment was politically motivated.A higher Vienna court in February 2017 rejected that reasoning as “insufficiently substantiated,” ruling that Firtash could be extradited.Austria’s Supreme Court of Justice upheld that ruling last month. Firtash’s defense team is led by former Austrian Justice Minister Dieter Boehmdorfer, who on Tuesday told Austrian national radio station O1 that reopening the case will prove “the U.S. does have a far-reaching political motivation” to secure Firtash. The U.S. investigation of Firtash was first reported in 2008, when he was named principal shareholder in an obscure company that was involved in lucrative gas deals between Russia and Ukraine. The U.S. extradition request led to Firtash’s 2014 arrest in Vienna.Bid to dismiss indictmentIn June, a Chicago federal judge rejected a motion to dismiss the indictment against Firtash, who has argued that the U.S. has no jurisdiction over crimes in India. However, federal Judge Rebecca Pallmeyer ruled that it does, because any scheme would have affected a Chicago-based company.Chicago-based U.S. aviation giant Boeing said it considered business with Firtash but never followed through. It is not accused of any wrongdoing. Before becoming Trump’s campaign manager, Manafort pursued a business deal with Firtash to redevelop a Manhattan hotel. Manafort isn’t accused of wrongdoing in the Chicago case.

Appeals Court Asked to Pause Antitrust Ruling Against Qualcomm

The U.S. Justice Department asked a federal appeals court to pause the enforcement of a sweeping antitrust ruling against mobile chip supplier Qualcomm on Tuesday, citing support from the Energy Department and Defense Department.”For DoD, Qualcomm is a key player both in terms of its trusted supply chain and as a leader in innovation, and it would be impossible to replace Qualcomm’s critical role in 5G technology in the short term,” Ellen M. Lord, Under Secretary for Defense for Acquisition and Sustainment, wrote in a filing made in the 9th Circuit Court of Appeals.Qualcomm, the largest supplier of modem chips that connect smartphones to wireless data networks, on May 21 lost in an antitrust lawsuit brought by the Federal Trade Commission earlier this year.U.S. District Judge Lucy Koh ruled that Qualcomm had engaged in anticompetitive patent-licensing practices to keep a monopoly on the mobile chip market. Koh ordered Qualcomm to license its technology to rival chipmakers, which include firms like Taiwan’s MediaTek and Huawei Technologies’s HiSilicon chip unit.Qualcomm has been fighting to have the ruling put on hold while it pursues an appeal. The San Diego, California, company has argued that letting the ruling stand could upend its talks with phone makers over chips for 5G, the next generation of wireless data networks.Koh declined to pause the ruling, bringing the case before the 9th Circuit. The Justice Department’s antitrust division had asked Koh to hold an additional hearing about potential penalties before she made her ruling, but she declined to do so.’Erroneous’ rulingIn a friend of the court filing on Tuesday, Justice Department attorneys argued her ruling was “erroneous” and called her decision to forego additional hearings “unlawful.”Energy Department officials also filed in favor of a pause.”DOE’s missions in nuclear security and protection of the Nation’s energy and nuclear infrastructure are dependent on secure and advanced wireless communications, of which Qualcomm is the major and predominant U.S. supplier of both current generation and upcoming 5G chipsets,” wrote chief information officer Max Everett.Lord wrote that the Defense Department “firmly believes that any measure that inappropriately limits Qualcomm’s technological leadership, ability to invest in research and development, and market competitiveness, even in the short-term, could harm national security.”
